We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us.

• Age Requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence (18 in Texas).
• Modifications: We may update these Terms at any time. Your continued use of the Site constitutes acceptance of those changes.

A. Product Use and Safety

Our products are handcrafted cosmetic fragrances intended for external use only.

• Flammability: ÉCLATAUR Eau de Parfum sprays contain high concentrations of organic grain alcohol. Keep away from heat, sparks, open flames, and hot surfaces. Do not smoke while applying.
• Patch Test: Our products contain natural essential oils and aromatic compounds. We recommend a patch test on a small area of skin before full use. You are responsible for reviewing the ingredient information on packaging to identify materials you may wish to avoid.
• Medical Disclaimer: Our products are not medications. They are not intended to diagnose, treat, cure, or prevent any disease. No content on this Site should be interpreted as medical advice.

B. Product Descriptions

We warrant that products will substantially conform to the description on the Site. However, we do not warrant that product descriptions, colors, or scents are perceived identically by every customer. Scent is subjective; a description of woody or floral is a guide, not a guarantee of your personal perception. This is precisely why every full-size ÉCLATAUR spray ships with a tester outside the sealed box under our Try Before You Unseal guarantee.

All content on this Site – including but not limited to the ÉCLATAUR brand name, the Evenore Solutions LLC trade names, logos, the VELUM proprietary base accord system, product formulas, packaging designs, text, photography, and the Site’s underlying code – is the exclusive intellectual property of Evenore Solutions LLC.

• Prohibited Use: You may not use our intellectual property for any commercial purpose without our prior written consent.

We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you using the email or billing contact information provided at the time the order was made.

• Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
• Payment Processing: All payments are processed securely through our e-commerce platform, WooCommerce, using third-party payment processors (such as Stripe and PayPal). We do not store full credit card numbers on our servers.
• Taxes: We are required by law to collect 8.25% sales tax on orders shipped to Texas addresses. Tax is calculated at checkout.

A. Ground Shipping Only (USA)

Due to federal Department of Transportation (DOT) regulations regarding Class 3 Flammable Liquids (perfume), all orders containing alcohol-based fragrance must be shipped via ground transportation. We currently ship within the United States only. Expedited air shipping is not available for any order containing fragrance.

B. Free Shipping Threshold

We offer free ground shipping on orders over $79 within the contiguous United States. Free shipping does not apply to orders shipped to Alaska, Hawaii, Puerto Rico, or Guam due to ocean freight surcharges. See our full Shipping Policy for complete details.

C. Risk of Loss

All items purchased from ÉCLATAUR are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (USPS or UPS).

ÉCLATAUR offers a Try Before You Unseal guarantee on all full-size Eau de Parfum sprays. Every full-size spray ships with a complimentary tester of the same scent and concentration, packed outside the sealed box. If the fragrance isn’t yours, return the unopened, sealed bottle within 14 days of delivery for a full refund of the product price. Customer covers return shipping. Original shipping charges are non-refundable.

• Final Sale Items: Opened sprays, roll-on perfume oils, testers from The Prelude Collection, Discovery Sets, Gift Sets, Édition Limitée releases, and any item marked Final Sale are non-returnable.
• Damaged Goods: If your product arrives damaged, you must notify us within 48 hours of delivery with photographic proof at support@eclataur.com.

• We are not responsible for examining or evaluating the content or accuracy of third-party sites linked from our Site.

You agree to indemnify, defend, and hold harmless Evenore Solutions LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

A. Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

B. Binding Arbitration

Any dispute or claim relating in any way to your use of any ÉCLATAUR service, or to any products or services sold or distributed by ÉCLATAUR, will be resolved by binding arbitration, rather than in court. The arbitration shall be conducted in Dallas County, Texas.

C. Class Action Waiver

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.
